Terms of Service

The agreement between you and Eldrbreak LLC for the WebActivity website, dashboard, API, embeds and the Web Live Activities apps. Written to match how the service actually behaves, so it is worth the few minutes.

Who We Are and Who This Covers

WebActivity is made by Eldrbreak LLC. These terms cover the website at webliveactivity.com, the dashboard, the developer API, the embed button, QR and App Clip pages developers place on their own sites, and the Web Live Activities apps for iPhone and Android, including the App Clip. By creating an account, calling the API, embedding one of our pages or installing an app, you agree to these terms and to our Privacy Policy. If you are using WebActivity for a company, you are agreeing on its behalf and you confirm you are allowed to.

Three groups of people use WebActivity, and different parts of these terms apply to each.

  • Developers and their team members, who create an account, build activities and call the API. Most of these terms are about you.
  • End users, whose phones run the Web Live Activities app. The section For End Users is yours, along with the general sections at the end.
  • Visitors, who browse this site or try the builder. The general sections apply to you.

Eligibility

You must be at least 13 to use WebActivity, and at least 18, or old enough to form a binding contract where you live, to create a developer account or buy a paid plan. We do not knowingly let anyone under 13 use the service.

Your Account

  • You sign up with an email address and password, or with Google, Apple or GitHub. A password sign-in also needs a code we email to you, and you verify a mobile phone number when you create your account. A phone number can belong to one account, and that is how we hold each person to one free team.
  • The details you give us need to be accurate and current enough that we can reach you about your account. Do not share your account, and tell us straight away if you think someone else has used it.
  • A session lasts up to 400 days from your last visit. Signing out ends that session, and resetting your password ends every other one.
  • There is no self-service account deletion yet. Email [email protected] and we will delete a verified account within 30 days. You can delete a team yourself from the dashboard at any time.

Teams

Everything you build lives in a team. A team is the billing unit. It holds the plan, the API keys, the activities, the push groups, the uploads and the members.

  • Your first team is created for you when you sign up and is the only team that can be on the free plan. Any further team you create needs a paid plan.
  • Every team has exactly one owner. Owners can rename or delete the team and hand ownership to someone else. Admins manage members and invitations. Billers see only billing and usage. Members can build and see usage. Owners, admins and billers can all change the plan, so the owner is responsible for charges any of them incur.
  • Deleting a team removes its API keys, webhooks, activities, push groups, logs and uploads, cancels its paid plan immediately, and locks every member out at once. There is no undo.
  • You are responsible for who you invite. Anyone you add can act for the team within their role, including sending content to end users under your name.

API Keys and Secrets

  • API keys belong to the team, not to the member who created them, and keep working when that member leaves. Everything sent with a key counts as sent by your team, whoever actually sent it.
  • Keys and webhook signing secrets are stored as issued so the dashboard can show them back to you. Treat them like passwords. Keep them on your server, never in browser or app code. If a key leaks, create a new one, then revoke the old one from the dashboard. Creating a key does not revoke earlier ones.
  • You may not share, sell or publish a key, or use one to let a third party call the API as your team.

Acceptable Use

An activity sits on someone’s Lock Screen and a notification interrupts them. Both are worth being careful with. Do not use WebActivity to:

  • send unlawful, misleading, defamatory, harassing, sexually explicit, hateful or deceptive content;
  • send content to people who have not chosen to receive it, or keep sending after they have opted out;
  • impersonate another business, product or person, or suggest an activity comes from someone it does not;
  • send malware, phishing links or anything designed to trick or harm the person receiving it;
  • collect personal data from end users beyond what the activity needs, or use the service to track people across other apps or sites;
  • infringe anyone’s copyright, trademark, privacy or other rights, including with the images you point us at;
  • work around plan allowances, billing or the free plan’s one-team rule, including by creating extra accounts;
  • interfere with the service, probe it for weaknesses without asking us first, resell it, or use it to attack anyone else.

We do not read activity content and we do not screen it before it goes out. That means we rely on you, and on reports from end users. If you see abuse, email us. We would rather talk to you than cut you off, but we can revoke keys, remove content or delete a team that breaks these rules, and we will act immediately where people are being harmed.

End Users and Consent

An end user chooses to track an activity or join a push group by tapping your button, opening your link or scanning your code. You are responsible for making sure they know what they are signing up for, for honoring their choice to leave, and for following the laws that apply to messaging your users where they live. An end user can remove an activity, leave a group or erase their device from the app at any time, and once they have we will not deliver to them again. You cannot override that.

Links Are the Key

An activity is addressed by the link that launched it, and a push group by the id in its join link. Anyone holding an activity link can view that activity’s content. Anyone holding a push group’s join link can join, leave, remove every subscriber from that group, or delete it. This is by design, so the apps can work without accounts, and it means you should:

  • put nothing in an activity you would not put in a link;
  • treat a join link as public the moment it is on a page or a poster;
  • keep a record of your ids so you can recreate a group if someone else deletes it.

We are not responsible for what someone does with a link you published.

Your Content

Whatever you send through the API or upload to the builder stays yours. You give us a worldwide, royalty-free license to store it, encrypt it, copy it, pass it to Apple and Google, and show it in the apps and on the pages you embed, for as long as it is on our servers. You are responsible for having the rights to send everything you send, and for making sure it does not break the rules above.

  • Ending an activity does not delete it. The activity, its latest content and its link stay until you, the end user or a team deletion removes them.
  • Delivery and webhook logs are kept for 90 days. Deleted records stay in encrypted backups until each backup ages out.
  • Uploaded images are converted to PNG and served from a public address. Anyone with the link can view one until you delete it. Each plan includes a storage allowance, shown on the pricing page, and uploads that would go over it are refused.
  • Images you reference by URL are fetched by the end user’s phone directly from your server. We never see them, but the rules above still apply to them.
  • If we receive a credible complaint that content infringes someone’s rights or breaks these terms, we can remove it and will tell you when we do. Send complaints about content you believe infringes your rights to [email protected].

Embedding on Your Site

  • The launch button, QR page and App Clip page are hosted by us and load inside a frame on your page. You may embed them on sites you control. They depend on our servers being up, and we may change how they look or work.
  • On the free plan the button carries a Powered By WebActivity mark, and you may not hide, cover or alter it. Paid plans can remove it and style the button.
  • Custom button styles you submit are served from our domain as you wrote them. You are responsible for that CSS, and we can remove styles that break the button, mislead people or harm anyone.

Plans and Billing

The plans, their monthly allowances and their usage rates are on the pricing page. Prices are in US dollars and exclude tax.

  • Stripe is the merchant of record. You buy a plan from Stripe on its checkout page. Stripe charges your card, issues invoices, calculates and remits any sales tax or VAT, and handles disputes. Card details never reach us. Stripe’s terms apply to the purchase alongside these.
  • What counts as usage. Usage is measured per delivery to a device, not per API call. One update to an activity tracked on one phone is one delivery. One notification to a group of a thousand phones is a thousand.
  • Free plan. The free plan is for your first team only and has a monthly allowance. When it is used up, the API refuses further starts, updates and sends until the first of the next month, UTC. Nothing is charged.
  • Paid plans are billed monthly. The base price is charged at the start of each period, and deliveries above the plan’s allowance are charged at the plan’s usage rate on the next invoice. Your activities keep working past the allowance rather than stopping at the line. There is no cap on usage charges, so watch the usage page.
  • Changing plans. Moving between paid plans takes effect at once and the difference is prorated on your next invoice. Cancelling, or moving a paid team to the free plan, ends the paid plan immediately. The rest of the period you already paid for is not refunded. Deleting a team ends its plan the same way.
  • Refunds. Charges already billed are not refunded except where the law requires it.
  • Failed payments. If a renewal charge fails, Stripe retries it over the following days and the service keeps running while it does. Update your card from the dashboard to retry at once. If the subscription lapses, the team drops to the free plan and its API keys keep working within the free allowance. A team that is not your first team needs a new paid plan before its dashboard opens again.
  • Price changes. We can change prices and allowances. We will give paid teams at least 30 days’ notice by email before a change affects them, and you can cancel before it does.

Delivery and Availability

We work to keep the service up and fast, but it is provided as it is and as available, without warranty of any kind, and we do not offer an uptime or delivery guarantee. In particular:

  • Delivery depends on the Apple and Google push services, which we do not control and which do not guarantee delivery or timing. A phone that is off or offline may receive only the latest update, or none.
  • Updates to the same activity are batched, and when several arrive in the same batch only the newest is sent. An update Apple or Google throttles is dropped, not retried. Starts and ends are retried.
  • iOS ends a Live Activity on its own after about eight hours. Activities started with keepAlive are restarted before then. iOS also limits how many alerting updates it delivers.
  • Webhooks are attempted up to five times, with an 8 second timeout on each, and can arrive out of order. Your endpoint must handle repeats.
  • Android shows a subset of activity layouts, and instant launch through the App Clip is iPhone only. Check the docs for what each platform supports before you build on it.
  • We may change, limit or stop features, and we will give notice of anything material where we can.

Support

Support is by email at [email protected]. A person answers, as quickly as we can, but we do not promise a response time.

For End Users

The Web Live Activities apps are free, need no account, and show you the activities and notifications you chose to follow. When you install one you also agree to Apple’s or Google’s app store terms.

  • The content of an activity or notification comes from the developer who sent it, not from us. We deliver it. If something an activity shows you is wrong, offensive or unwanted, remove the activity or leave the group in the app, and contact that developer first. If you believe a developer is breaking these terms, email us and we will look.
  • You can remove any activity, leave any group, or use Clear All Data to reset the app. What each of those does with the record on our servers is set out in the Privacy Policy.
  • Do not use the apps to interfere with the service or with anyone else’s activities, including by using a link you were not meant to have.
  • We may update, change or discontinue the apps at any time. Older versions may stop working when we do.

Suspension and Termination

You can stop using WebActivity at any time by deleting your teams and emailing us to delete your account. We can revoke your keys, remove content, delete a team or refuse you service if you break these terms, do not pay, or put the service or its users at risk. Except in urgent cases we will email you first and give you a chance to fix the problem. When a team or account ends, its data is deleted as described in the Privacy Policy, and the sections of these terms that by their nature should survive, such as Your Content, Liability and Disputes, do.

Our Property

The service, the apps, the site, the docs, the WebActivity and Web Live Activities names and our logos belong to us or our licensors. You may use them only as these terms allow. Do not copy, modify, reverse engineer or resell the service, or remove notices from it. If you send us ideas or feedback we can use them without owing you anything.

Third-Party Services

WebActivity is built on Apple’s and Google’s push services, Stripe, and the other providers listed in the Privacy Policy. Their terms govern your dealings with them, and we are not responsible for their services or for anything a developer or end user does with ours.

Liability

To the extent the law allows, neither we nor Eldrbreak LLC’s members, staff or suppliers are liable for lost profits, lost revenue, lost data, missed or late deliveries, or indirect, special or consequential damages, however caused. Our total liability for everything arising out of these terms or the service is limited to the greater of what you paid us in the twelve months before the claim and one hundred US dollars. Nothing here limits liability that cannot be limited by law.

Indemnity

If you are a developer, you will defend and cover us against any claim, loss or cost arising from the content you send, the sites you embed on, your breach of these terms, or your team’s use of the service.

Disputes

These terms are governed by the laws of the United States and of the state in which Eldrbreak LLC is organized, without regard to conflict of law rules. Any dispute goes to the state or federal courts located there, and both of us agree to their jurisdiction. Before filing, email us and give us 30 days to sort it out.

Changes to These Terms

We may update these terms as the service changes. The current version is always on this page with the date at the top. If a change matters to you we will tell account holders by email before it takes effect, and continuing to use the service after that means you accept it.

General

  • These terms and the Privacy Policy are the whole agreement between you and us about WebActivity.
  • If a court finds part of these terms unenforceable, the rest still stands.
  • Not enforcing a term is not a waiver of it.
  • You may not assign these terms. We may assign them to a successor, and your data goes with them under the Privacy Policy.
  • You confirm you are not barred from using US services by sanctions or export laws.
